Terms and Conditions
All applicants must submit their information with a verified signature to confirm that they have read the terms and conditions of listing and comply with the requirements.
(1) Applicant
- The applicant confirms that they are a micro or SME business.
(If uncertain, please contact the Local Enterprise Office for guidance.)
(2) Food & Beverage
- The business produces/processes food/beverages for retail or consumer use or
- Provider of professional food services such as private hire/off premises catering, services or supplies to the food industry or
- Provides food experience services to the public (e.g. cookery school)
(3) Local
The product or service is produced in/operates from a base in Co. Kildare.
*Produced in Co. Kildare means:
- Grown, processed and packed in Co. Kildare
- Main ingredient is produced/grown in Co. Kildare
- Grown within Kildare but is slaughtered or processed outside the County, but inside Ireland
- Main ingredient is produced/grown outside Kildare, but most of the production and craft process is carried out in Co. Kildare.
- Main ingredients are sourced from outside Co. Kildare, but are processed within the County
- Business originates in Co. Kildare and majority owned by entrepreneur in Co. Kildare.
(4) Accuracy and Verification
- The applicant accepts full responsibility for the accuracy of all information included in their application
- Applicants undertake to provide Kildare County Council with immediate updates on any changes to the content or accuracy of listing details.
- Food producers supplying products listing information have a legal duty to ensure that all information provided, including product descriptions, ingredients lists, nutritional details, and any claims made about the products is accurate, not misleading, verifiable and fully complies with applicable Irish and EU food legislation, including but not limited to the Food Safety Authority of Ireland (FSAI) regulations and EU Regulation (EU) No. 1169/2011 on food information to consumers. Producers are solely responsible for ensuring ongoing compliance and must update any information as required to reflect changes in legislation or product formulation.
- Listing content provided should comply with current Codes of Standards for Advertising and Marketing Communications in Ireland. Food & Non-Alcoholic Beverages - ASA Code - Advertising Standards Authority
(5) Agreement and Indemnity
- Applicants agree to prevent any breach or infringement of rights of other parties including trademark, copyright or other intellectual property rights including contractual agreements on confidential information.
- By submitting information, the producer agrees to indemnify Kildare County Council and hold the publisher harmless form any claims, losses or damages arising from any inaccuracies or non-compliance. Any disputes shall be governed by Irish Law and resolved under Irish Jurisdiction
